Biogy LLC ("Biogy") warrants to the Purchaser that its FingerGear products are free from defects in material and workmanship under normal use for the time period indicated below. If the FingerGear product you have purchased does not comply or function as specified with this warranty during the warranty period, you may be eligible to return the product for a replacement.

Subject to the conditions and limitations set forth below, Biogy will at its option, either repair or replace any part of its product(s) that prove defective by reason of improper workmanship or materials. Repaired parts or replacement products will be provided by Biogy on an exchange basis, and will be either new or refurbished to be functionally equivalent to new. This warranty does not cover (i) items normally consumed during product operation or (ii) any failure or damage that results from non-Biogy products, accident, abuse, misuse, natural or personal disaster, or any unauthorized disassembly, repair, or modification. The purchaser will be responsible for shipping charges.

One-Year Warranty: The following Biogy products are covered by this warranty for a period of one year from the original date of purchase: FingerGear Computer-On-A-Stick and FingerGear Bio Flash Drives, including all versions thereof. This warranty only covers repair or replacement of defective Biogy products, as provided above. Biogy is not liable for, and does not cover under warranty, any costs associated with servicing and/or the installation of Biogy products. Biogy will not discontinue support of its products, nor obsolete its products, as long as there are component materials available in the marketplace and reasonable customer demand for the products.

THESE WARRANTIES AND LIMITATIONS ARE YOUR EXCLUSIVE WARRANTIES AND SOLE REMEDIES AND REPLACE ALL OTHER WARRANTIES, REPRESENTATIONS OR CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, TO THE EXTENT PERMITTED BY APPLICABLE LAW, IMPLIED WARRANTIES, REPRESENTATIONS OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE.

IN NO EVENT WILL BIOGY BE LIABLE TO YOU OR TO THE USER OF A BIOGY PRODUCT FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE,INCIDENTAL OR CONSEQUENTIAL DAMAGES OR FOR ANY EXPENSES, LOST REVENUES, LOST SAVINGS, LOST PROFITS, LOST GOODWILL, OR ANY OTHER FORMS OF ECONOMIC LOSS, EVEN IF BIOGY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BIOGY'S LIABILITY EXCEED THE PRICE PAID FOR THE APPLICABLE BIOGY PRODUCT, REGARDLESS OF THE CAUSE AND WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.

BIOGY PROVIDES THIRD PARTY ITEMS ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND. However, such third party items may carry their own warranties and Biogy will pass through to you any such warranties to the extent authorized.

If this product is purchased by a consumer and not in the course of a business, this warranty shall not affect your statutory rights as a consumer.
